McAllen Police Chief Victor Rodriguez said the department will be consulting with the Hidalgo County District Attorney’s Office to upgrade the charge to capital murder.
Police said Andres Roberto Ortiz beat Jose Luis Oviedo, stole his car before crashing it into a canal last month.
Investigators found Oviedo injured outside of his home. Ten days after the incident, police said they connected Ortiz to the crime.
Oviedo’s son said his father was in the U.S. Navy for 15 years and served in Operation Desert Storm.
