BREAKING : Democrats Hatch Last Minute PLOT to Confirm Liberal Judge Merrick Garland to Supreme Court
For a few minutes on January 3, 2017, Democrats will control the Senate.
How can this be?
Well, one-third of Senate seats were up for re-election this year.
Those terms expire at noon on January 3, 2017.
The new incoming class will be sworn in minutes later.
However, during that gap, the Senate will have 67 sitting members.
A majority of which are Democrats.
The idea being proposed is this: Biden convenes the Senate in those few minutes and calls for a vote. The majority suspend the rules and vote in Merrick Garland.
Of course, an act like this would go against the whole “peaceful transition of power” and who knows the legal implications of a move like that.
However, with how angry the liberals are over losing, would you put this past them?

According to the constitution, there is no lapse of time between a Senate term ending and the new one beginning…both happen at NOON, on 1/20. Also, according to the Senate rules, swearing in new Senators takes priority over any other Senate business, like confirming Supreme Court nominees. Nice try, poor loser Democrats!!

If the Dems were to try this, it would completely run roughshod over the Advice & Consent rule required prior to any confirmation vote on a judge appointment. Of course, since when do laws, rules, decorum and and long-established protocol matter to Dems.
How many of that “majority” of democratic Senators remaining after the swearing in will be up for re-election in 2018? That majority is over after the swearing in, but dirty tricks can also lose you some more of those democratic Senators up for re-election. And just as Scalia died mysteriously, so can the sitting progressive SCOTUS justices.
Though I doubt the liberals can pull off a stunt like that, if they were to try it’d be just another reason for middle America to reject them in2018.

This is of course not doable. But there is a way for them to seat a liberal Justice for up to two years.
When the Senate shuts down and heads home for Christmas Obama could appoint a justice. I doubt even he would do such a thing, but these libs today are so very angry he could try. They only way to stop that is for McConnell to keep the Senate open, at least one Senator would have to be in DC until the congress returns.
Do not doubt that they have not been contemplating this.
